These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Etherpromotions (“Company,” “we,” “us,” or “our”), concerning your access to and use of our website, graphics services, subscription models, and website builder tools. Accessing the service constitutes full acceptance of these terms.
Our Property: Unless otherwise indicated, the website builder, proprietary code, Laravel/Flutter frameworks, global hex-code configurations, and original design templates are our proprietary property.
Your Content: You retain ownership of the specific text and personal images you upload. However, by using our website builder, you grant us a license to host and display that content as part of your service.
License to Graphics: Upon full payment for subscription or custom design services, you are granted a non-exclusive, non-transferable license to use the final graphic assets for your business purposes.
By using the site, you represent that:
You have the legal capacity to comply with these Terms.
You will not use the website builder for any illegal or unauthorized purpose, including the sale of prohibited substances or copyright-infringing material.
You will not attempt to reverse-engineer our software or "scrape" our graphics database.
Billing: We use secure third-party payment processors. You agree to provide current, complete, and accurate purchase and account information for all purchases.
No Refunds: Due to the digital nature of our assets and the immediate access provided to the website builder, all sales are final. Subscription cancellations stop future billing but do not result in a refund for the current period.
Chargebacks: Any fraudulent chargeback will result in the immediate and permanent termination of your account and a revocation of all digital licenses previously granted.
IN NO EVENT WILL ETHERPROMOTIONS OR OUR DIRECTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SERVICES. We provide our tools "AS IS" and "AS AVAILABLE."
We respect the intellectual property rights of others. If you believe that any material available via our website builder infringes upon any copyright you own or control, please immediately notify our support team.
These Terms shall be governed by and defined following the laws of North Carolina, United States. You irrevocably consent that the courts of North Carolina shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
We reserve the right to change, modify, or remove the contents of the Services at any time for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
